                                                      JUDGMENT

(Delivered by M.M.SUNDRESH, J.)

This appeal is directed against the order dated 30.09.2013 made

in C.P.No.141 of 2005.

2.The matter has been settled between the parties as submitted

by the learned counsel appearing for the appellant and the learned

counsel appearing for the respondent.

3. Accordingly, the following terms have been agreed and the

terms of the settlement are as follows:

(i) the appellant has received a sum of

Rs.3,00,000/- (Rupees Three Lakhs Only) from the

respondent.

(ii) the payment made during the pendency

of the proceedings in favour of the appellant is

also acknowledged as part of the claim.

(iii) the remaining amount i.e. Rs.4,00,000/-

(Rupees Four Lakhs only) lying on the file of this

Court in C.P.No.141 of 2005 along with interest if

any deposited in the Indian Bank, High Court

Branch, Madras, shall be permitted to be

withdrawn by the Registry and the Registry is

further directed to hand over the cheque to the

learned counsel for the appellant -

Mr.P.Neelakandan.

(iv) There shall not be any further claim

between the parties, particularly from the

respondent to the appellant.

4.The writ appeal stands disposed of accordingly. No costs.

Consequently, connected miscellaneous petitions are closed.

5.This Court places on record the valuable assistance extended

by the learned counsel for the parties in arriving at an amicable

settlement.
