                                                         JUDGMENT

(Delivered by the Hon'ble Acting Chief Justice)

Learned counsel for the appellant seeks to withdraw the

appeal with liberty to approach the learned Single Judge seeking

modification of the order dated 9.12.2021.

2. Learned Senior Counsel for the respondent has prayed for

liberty to raise their objection to the remedy aforesaid availed by

the appellant before the learned Single Judge.

In view of the above, we dismiss the appeal as withdrawn with

with liberty as prayed for. The respondent would be at liberty to

take appropriate objection therein, if it is available to them. No

costs. Consequently, C.M.P.No.20987 of 2021 is closed.
