                      Judgment and decree of trial court dated 26.10.2004 made in O.S.No.2097
                      of 1995 on the file of IV Assistant City Civil Court, Chennai decreeing the
                      suit of the plaintiffs against the appellant herein.

                                                      JUDGMENT

The matter is listed under the caption for dismissal today. Learned

counsel for the Appellant has expressed his difficulty in getting particulars of

the legal representatives of the deceased respondents. A memo to that effect

has also been filed before this Court.

2. Learned counsel for the second respondent has also submitted that

he is unable to contact his client for getting details of the legal

representatives of the deceased respondents. Since the second appeal is of

the year 2006, no useful purpose will be served if the second appeal is kept

pending.

3. Since the legal representatives of the deceased respondents have not

been brought on record till date, the second appeal is dismissed for non-

prosecution. No costs.
