                Code, against the judgment and decree dated 12.01.2005 made in A.S
                No.90          of   2004   on   the     file   of    the    Principal   District   Court,
                Ramanathapuram,             confirming         the   judgment     and    decree    dated
                17.10.2003 made in O.S No.333 of 1989 on the file of the Additional
                District Munsif, Ramanathapuram.

                                                       JUDGEMENT

This second appeal was filed by advocate Mr.V.Sitharanjandas.

He passed away quite sometime back. His colleague Mr.D.Senthil,

informs the court that even though he wrote letters to the appellant,

there has been no response. It is also seen that the first appellant

passed away and his legal heirs were brought on record vide order

dated 12.02.2008. Since the appellants have not come forward to

prosecute the appeal, the appeal is dismissed for default. No costs.
