                                                                ORDER

This is first anticipatory bail application under Section 482 of the BNSS filed by the applicant who is apprehending his arrest by Police Station- Cantt. Guna, District- Guna in connection with Crime No.214/2026 for the offence punishable under Sections 4-A of Public Gambling Act and Section 112(1) of BNS.

2. Learned counsel for the applicant has submitted that the applicant is apprehending his arrest on the basis of aforesaid offence. It is further

submitted that the applicant has not committed any offence. The applicant is innocent and has been falsely implicated in the present case. No incriminating material has been recovered from the possession of the applicant. He has been implicated in the matter on the basis of memorandum of co-accused. The entire case of the prosecution is based on presumption and conjecture without any concrete proof indicating that the applicant was

2 MCRC-20185-2026 operating or facilitating any online betting activity. The offence is triable by JMFC. Trial will take some considerable time. Investigation is almost over. Applicant does not bear any criminal record. Applicant undertakes to cooperate in trial as well as investigation and would make himself available as and when required. He would abide by the terms and conditions as imposed by this Court. This Court by order dated 21.4.2026 passed in M.Cr.C.No.17780/2026 has granted anticipatory bail to co-accused Mukesh Singhai. Under these circumstances counsel for the applicant prayed for grant of anticipatory bail.

3 . Learned counsel for the respondent/State has vehemently opposed the prayer and prayed for dismissal of the application.

4. Heard the counsel for the parties and perused the case diary.

5 . Considering the above submissions and facts situation of the case but, without expressing any opinion on the merits of the case, this Court intends to allow the application, therefore, it is hereby directed that in the event of his arrest, the applicant shall be released on bail on furnishing a personal bond in the sum of Rs.50,000/- (Rs. Fifty Thousand Only) with one solvent surety of the like amount to the satisfaction of Arresting Authority/Trial Court.

6 . This order will remain operative subject to compliance of the following conditions by the applicant:-

i. The applicant will comply with all the terms and conditions of the bond executed by him;

ii. The applicant will cooperate in the

3 MCRC-20185-2026 investigation/trial, as the case may be;

iii . The applicant will not indulge himself in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to the Police Officer, as the case may be.

iv. The applicant shall not commit an offence similar to the offence of which he is accused;

v. The applicant will not seek unnecessary adjournments during the trial;

vi. The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be;

vii.The applicant shall mark his presence on first Sunday before the Police Station Cantt. Guna, District Guna between 10:30 am to 2:30 pm, till conclusion of trial.

7. Application stands allowed and disposed of. 8 . Copy of this order be sent to the trial Court concerned for compliance.

9. Certified copy as per rules.
