                                                                     ORDER

Today, due to call of High Court Bar Association, Gwalior, lawyers are abstaining from work. Therefore, wife of the applicant is heard.

This is the first application filed by the applicant under Section 483 of B.N.S.S. for grant of bail. The applicant has been arrested in connection with Crime No.12/2026 registered at Police Station - Matabasaiya, District - Morena (M.P.) for the offence under Section 34(2) and 49(A) of the Excise Act and Section 25/27 of Arms Act.

As per the prosecution case, 567 bulk liters of country-made illicit

liquor has been found from the possession of present applicant.

Wife of the applicant submitted that applicant is innocent and has been falsely implicated. He is in custody since 16.01.2026.

It is seen from the record that the alleged liquor has already been seized. Offence is triable by the JMFC and trial is likely to take long time to conclude. Applicant is the permanent resident of District - Gwalior (M.P.) and there is no possibility of his absconsion or tampering with the

prosecution evidence, if released on bail.

As the learned Advocates are abstaining from work, therefore, clerical Staff of the Office of Advocate General extended the case diary of the case to assist this Court.

Heard and perused the case diary.

From perusal of the record, this Court finds that co-accused- Pradeep Sikarwar has already been enlarged on bail by this Court vid order dated 17.02.2026 passed in M.Cr.C. No.7922/2026. However, this Court also finds that the applicant bears criminal record of two cases.

Considering the above facts and circumstances of the case and on the ground of parity also, but without expressing any opinion on merits of the

case, this application is allowed and it is directed that the applicant be released on bail on furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) along with one solvent surety in the like amount to the satisfaction of the trial Court/Committal Court.

This order will remain operative subject to compliance of the following conditions by the applicant:-

i) The applicant will comply with all the terms and conditions of the bond executed by him/her;

ii) The applicant will cooperate in the investigation /trial, as the case may be;

iii) The applicant will not indulge himself /herself in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such acts to the Court or to

3 MCRC-9884-2026 the Police Officer, as the case may be;

iv) The applicant will not commit any other offence or will not repeat the offence in future.

v) The applicant will not seek unnecessary adjournments during the trial; and

vi) The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be.

vii) The applicant is directed to mark his presence before the concerned police Station i.e. P.S- Matabasaiya District Morena, on every Sunday, till conclusion of trial, failing which this bail application shall stand automatically cancelled.

viii) It is made clear that if the FSL report is found positive and the liquor is found poisonous/unfit for human consumption, then this bail order shall stand automatically cancelled and the applicant shall surrender before the concerned court immediately.

E- copy of this order be sent to the trial Court concerned for compliance.
