This is second bail application u/S.439 CrPC/483 of BNSS filed by the applicant for grant of bail. His first bail application was dismissed as withdrawn vide order dated 13.01.2026 passed in M.Cr.C. No.59002/2025 with liberty to renew the same after filing of charge sheet.

The petitioner has been arrested on 01.12.2025 by Police Station Pichhore, District Gwalior (M.P.) in connection with Crime No.171/2025 registered in relation to the offences punishable u/S. 109(1), 126(2), 190, 191(2), 191(3), of BNS and Section 25, 27 of Arms Act.

According to the prosecution case, the complainant was travelling in his Safari car when, on the way, the accused persons arrived on two motorcycles and stopped him. Thereafter, accused Pankaj fired a gunshot at the complainant, which grazed his head and passed through. He then fired two to three more gunshots, which hit the mirror and tyre of the car. Subsequently, the accused persons, namely Bhanu, Satnam, Kuldeep, Prabhan, and one unknown person, assaulted the complainant. At that time, the complainant's brother and friend arrived at the

2 MCRC-9688-2026 spot, upon which the accused persons fled from the scene. On the basis of the aforesaid incident, the present case has been registered against the applicant and other co-accused persons.

Learned counsel for the applicant submitted that the applicant is innocent and has been falsely implicated in this case. The applicant is in judicial custody since 01.12.2025. The applicant is permanent resident of Distt. Gwalior and there is no likelihood of his absconsion or tampering with the prosecution evidence. Applicant undertakes to cooperate in investigation/trial and would not be a source of embarrassment and harassment in any manner to the complainant party side. The applicant is ready to abide by all the terms and condition as imposed by this Court. Under these grounds, learned counsel prayed for anticipatory bail.

Learned counsel for the respondent/State has vehemently opposed the

prayer and prayed for dismissal of the application.

Heard the counsel for the parties and perused the case diary. Taking into account the overall facts and circumstances of the case, the arguments advanced by learned counsel for the parties coupled with the fact that the trial is not likely to conclude in near future and prolonged pre- trial detention being an anathema to the concept of liberty, this Court is inclined to extend the benefit of bail to the applicant.

Accordingly, without expressing any opinion on merits of the case, this application is allowed and it is directed that the applicant be released on bail on furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount to the satisfaction of the trial Court/committal Court for his appearance on the dates given by the concerned Court.

This order will remain operative subject to compliance of the following

3 MCRC-9688-2026 conditions by the applicant:-

1. The applicant will comply with all the terms and conditions of the bond executed by him;

2. The applicant will cooperate in the investigation/trial, as the case may be;

3. The applicant will not indulge himself in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to the Police Officer, as the case may be;

4. The applicant shall not commit any other offence during pendency of the trial, failing which this bail order shall stand cancelled automatically, without further reference to the Bench;

5. The applicant will not seek unnecessary adjournments during the trial; and

6. The applicant will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be.
