                                                                  ORDER

The petitioner has filed this petition seeking following reliefs:-

"I. Issue a writ in the nature of mandamus directing the concern Respondents to forthwith appoint/engage the petitioner as Guest Teacher Category-I (Commerce Subject) at Government School of Excellence, Nazi (District Balaghat) strictly in accordance with her first rank in the Lanji Block Panel Merit List, in compliance of the earlier order of this Hon'ble Court and applicable Government guidelines.

II. Issue a writ in the nature of mandamus directing the concern Respondents to ensure immediate joining of the petitioner before the end of the current

2 WP-5136-2026 academic session 2025-26 (i.e., on or before 28.02.2026), giving her priority over any lower-ranked or already working candidate.

III. Issue a writ in the nature of mandamus directing the concern Respondents to immediately update and reflect the vacant posts of Commerce (Guest Faculty Category-I) on the official portal as per the guidelines issued for the academic session 2025-26.

IV. Issue a writ in the nature of mandamus directing the concern Respondents to consider the candidature of the petitioner for engagement/appointment as Guest Teacher Category-I in Commerce subject, against the available vacant posts in Government Schools of District Balaghat, strictly in accordance with the merit panel and applicable rules/guidelines.

V. Issue any other writ, order or direction as this Hon'ble Court deems fit."

The counsel for the petitioner contends that highlighting the aforesaid grievance, the petitioner has moved a representation dated 22.12.2025 (Annexure P-8) before respondent No. 4/District Education Officer, Balaghat, which is still pending consideration, therefore, same be directed to be decided expeditiously.

3. The aforesaid innocuous prayer is not opposed by the counsel for the respondents.

4. In view of the aforesaid innocuous prayer, without expressing any view on the merit of the case, the petition stands disposed of with direction to respondent No. 4 to take decision on petitioner's representation dated 22.12.2025 (Annexure P-8) within a period of 30 days from the date of production of certified copy of this order by passing a well reasoned and speaking order in accordance with law.

5. If petitioner is found entitled and there is no impediment or embargo, the aforesaid benefits be extended to the petitioner within a further period of 30 days without compelling her to revisit this Court for the said purpose, otherwise reasons be communicated to the petitioner within the said period.

6. It is made clear that this Court has not expressed any view on the merit of the case and respondent No. 4 shall be at liberty to deal with the representation of the petitioner, in his own wisdom, in accordance with law.
