2. This first application under Section 483 of Bhartiya Nagarik Suraksha Sanhita, 2023/439 of Cr.P.C. has been filed for grant of bail.

3. The applicant has been arrested on 19.12.2025 in connection with Crime No.362/2022 registered at Police Station Nagod, District Satna, for offence under Sections 399, 402 of IPC and Section 25-B, 25, 27 of Arms Act.

It is submitted by counsel for applicant that earlier the applicant was granted bail by the Sessions Court by order dated 22.08.2022 but later on by order dated 14.10.2025, the bail was cancelled on the ground that even after his release, he has committed multiple offence. It is submitted that he was granted bail in crime Nos.493/2023, 134/2024 and 303/2025. Furthermore, it is submitted that now the applicant is in jail from 19.12.2025 and the only

2 MCRC-7445-2026 allegation made against the applicant was that he alongwith other accused was making preparation for committing dacoity.

5. Per contra, the application is vehemently opposed by counsel for the State. It is submitted that even after the release of applicant in the year 2022, he did not improve his conduct and even one proceeding for externment was also initiated.

Considering the nature of allegation, which was levelled against the applicant coupled with the fact that even in the subsequently registered offences, the applicant has been granted bail and the applicant is in jail for the last two months after his rearrest, this Court is of considered opinion that the applicant can be granted bail only on stringent condition of marking his

presence before the S.H.O. Police Station Nagod, District Satna, on 1s t and

15th of every month.

7. Accordingly, application for grant of bail is hereby allowed. It is directed that applicant be released on bail on furnishing a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac) with one surety in the like amount to the satisfaction of the Trial Court/Committal Court to appear before the Court on the dates given by the concerned Court. It is further directed that applicant shall mark his presence before S.H.O. Police

Station Nagod, District Satna, on 1s t and 15t h of every month. Any default in appearance would result in automatic cancellation of his bail order, therefore, in case if the applicant fails to appear before the S.H.O. Police Station Nagod, District Satna on any date, then the same shall be immediately informed to the trial court and the trial court shall take further

8. This order shall remain effective till the end of trial but in case of bail jump, it shall become ineffective and the trial Court shall be free to take the applicant in custody.

9. In the light of the judgment passed by the Supreme Court in the case of XYZ and Others Vs. State of M.P. and Another, reported in (2021) 16 SCC 179 , the intimation regarding grant of bail be sent to the complainant.
