Heard on I.A. No. 31224 of 2024, which is First application under Section 430(I) of the Bharatiya Nagarik Suraksha Sanhita, 2023, for suspension of sentence and grant of bail to appellant Suhag @ Robbie Bamrele.

The appellant is aggrieved of the judgment dated 25.10.2024 passed by learned Second Additional Judge to the Court of learned Addl. Sessions Judge, Bareli District Raisen in Sessions Trial No. 144 of 2022, whereby appellant Suhag @ Robbie Bamrele has been convicted and sentenced as

It is submitted by learned counsel for the appellant that the deceased is Priyanka. Her marriage was performed with the co-accused Brijendra Malviye on 13.02.2013. There were certain marital discords between them and a case under Section 125 Cr.P.C. was also pending. On the fateful day i.e. on 14.03.2022, Priyanka had visited her mother. Thereafter, on 15.03.2022 when Priyanka was returning back, she was accompanied with Brijendra in the car being driven by Suhag (present appellant) at about 11:00 p.m. It is submitted that, an intimation was received on 16.03.2022 that an accident took place and Priyanka died in the said accident. Complainant had visited Udaypura Hospital and found Priyanka to be dead.

It is submitted that, in short postmortem report, Dr. Mahendra Singh

Dhakad (PW-12) has mentioned that cause of death was smothering and throttling. That is attributed to the husband i.e. Brijendra Malviya and at best Suhag @ Robbie Bamrele will be guilty under Section 201 of IPC. It is also submitted that, appellant remained in custody since 17.03.2022 till 25.10.2024 and from the date of judgment i.e. 25.10.2024 till date. Thus, he has spent about more than 3½ years in custody. He has no direct connection with the offence. There are good chances of success in appeal. The final disposal of the appeal would take considerable time. He, therefore, prays for suspension of sentence and grant of bail to the present appellant.

Learned Government Advocate for the respondent/state and the learned counsel for the objector supports the impugned judgment and vehemently opposes the prayer for bail.

3 CRA-13276-2024 Heard learned counsel for the parties and perused the record.

After hearing learned counsel for the parties and considering the fact that there appears to be good chances of success in appeal, without commenting on merits of the case, this Court is of the opinion that it is a fit case to suspend the remaining part of jail sentence of appellant Suhag @ Robbie Bamrele and release him on bail.

Accordingly, I.A. No. 31224 of 2024 is allowed.

It is directed that on depositing of the fine amount, if not already deposited and on furnishing personal bond to the tune of Rs.50,000/- (Rupees Fifty Thousand Only) with two sureties in the like amount to the satisfaction of the Trial Court for his appearance before the Trial Court on 19/12/2025 and on all subsequent dates as may be fixed by the concerned Court, the execution of remaining part of jail sentence of appellant Suhag @ Robbie Bamrele shall remain suspended and he be released on bail till final disposal of this appeal.
