                                                                    ORDER

This revision petition has been filed by the applicants under Section 397/401 of Cr.P.C. being aggrieved by the appeal judgment dated 04.07.2019 passed by Second Additional Session Judge, Bijawar, District Chhatarpur (M.P.) in Criminal Appeal No.77/2017 (Ramsevak and Others Vs. State of M.P.) affirming the judgment dated 31.01.2017 passed by the Judicial Magistrate First Class, Badamalehra, District Chhatarpur (M.P.) in Criminal Case RCT No.286/2015(State of M.P. Vs. Ramsevak & Others ) convicting

the applicants/accused under Sections 325/34 (two counts) and 323/34 of IPC and sentencing them to undergo R.I. for one year each and R.I for one month each, respectively with fine of Rs.500/- and 200/- each, respectively with default stipulation.

2. During pendency of this revision petition, I.A. No.17144/2025 under Section 359(6) of Bhartiya Nagrik Suraksha Sanhita, 2023 for

2 CRR-3279-2019 compromise has been filed stating that the applicants & complainant have resolved the dispute amicably and now, they do not want to pursue the matter any more.

3. This Court vide order dated 21.07.2025 directed the Registrar (J-II) of this Court to verify the correctness and genuineness of the compromise application and to furnish his report. Upon the directions of this Court, the Registrar (J-II) has examined the complainant and the counsel for the applicant and submitted his report dated 11.08.2025. According to the report, the complainant has voluntarily desired to compound the offence with the applicants & the complainant and applicants have entered into a compromise without any kind of threats, inducements and coercion.

4. As parties have entered into compromise on their own and have

settled their dispute amicably, they are permitted to compound the offence. Accordingly, this revision petition in the light of compromise entered into by the parties, is allowed.

5. Consequently, judgment dated 31.01.2017 passed by Judicial Magistrate First Class, Badamalehra, District Chhatarpur (M.P.) in Criminal Case RCT No.286/2015 (State of MP Vs. Ramsevak & Others ) and appellate judgment dated 04.07.2019 passed by Second Additional Session Judge, Bijawar, District Chhatarpur (M.P.) in Criminal Appeal No.77/2017 (Ramsevak & Others Vs. State of M.P. ), are set-aside and applicants are acquitted of the offence under Sections 325/34 (two counts) and 323/34 of IPC. They are entitled to receive back the fine amount deposited before the trial Court.

3 CRR-3279-2019 6 . Registry/trial Court is directed to prepare super-session warrant/release warrant and to send the same to the Superintendent of jail/Jail authorities concerned with a direction that if applicants/accused are not required in any other case, they be released in this case forthwith.

7. Learned trial Court is directed to ensure the aforesaid compliance. 8 . Let records of Trial Court as well as Appellate Court along with copy of this order be sent to the Courts concerned for information and necessary compliance through Session Judge, Chhatarpur (M.P.).

9. Accordingly, this revision stands disposed of accordingly.
