Counsel for the petitioner submits that by the impugned order, the appeal under Section 92 of M.P Panchayat Raj and Gram Swaraj Adhiniyam, 1993 has been dismissed in absence of petitioner. It is argued that the Appellate Authority

could not have dismissed the appeal on merit in absence of counsel for the petitioner. At the most, the appellate Authority could have dismissed the appeal for want of prosecution. He prays for time to cite judgments other then on CPC, in support of his contention.

Considering the same, list after ensuing summer vacation.
