Counsel appearing for appellants submitted that Reference Court has committed an error of law in remanding the matter back. Reference Court does not have any jurisdiction. He relied upon judgment passed by Apex Court in

case of Kunnari Mullick Vs. Ghanshyam Das Damani, reported in (2018) 11 SCC 328.

Issue notices to respondents on payment of P.F. within seven days. Notices be made returnable within four weeks. Order dated 04.07.2023 shall remain stayed till next date of hearing. Counsel appearing for appellant is directed to remove all the defaults within period of two weeks, failing which, appeal shall stand dismissed without further reference to the Bench.
