Petitioner has filed this petition under Section 482 of the Cr.P.C. against order dated 14.02.2023 by which an application 319 of the Cr.P.C. was allowed
and petitioner was made an accused in the case.
Learned Senior Advocate appearing for petitioner relied upon the judgment reported in Jogendra Yadav and Ors. Vs. State of Bihar, 2015 Vol. 9 SCC 244 in para 9. It is submitted that before making a person accused in the case on application section 319, said person is to be given an opportunity of hearing.
Further proceedings in S.T. No.537/2016 pending before 25th Additional Sessions Judge, Jabalpur shall remain stayed till next date of hearing.
List after four weeks.
