This second appeal under Section 100 of the Code of Civil Procedure, 1908 has been filed against the judgment and decree dated 28/02/2020 passed by First Additional District Judge, Sironj, District- Vidisha (M.P.) in Civil Appeal No.17A/2019 confirming the judgment and decree dated 17/09/2019 passed by learned First Civil Judge, Class-I, Sironj, District - Vidisha (M.P.) in Civil Suit No.29A/2018.
The appeal involves and is admitted on the following substantial questions of law;
"1. Whether, the learned Courts below committed substantial error of law in dismissing the suit of plaintiff despite holding that sale deed Ex.P-1 in favour of plaintiff has been duly executed?
2. Whether, in view of the finding that sale deed Ex.P-1 is a genuine document the learned Courts below can dismiss the suit of plaintiff relying on findings of revenue Court which are without jurisdiction and perverse?"
