"1. Whether the Court below erred to decide legal provisions pertaining to setting aside the Judgment and Decree passed in C.S. No. 21-A/2011 dated 30.06.2011 resjudicata ?

2 . Whether the Court below failed to consider law of limitation which barred the suit of the plaintiff ?

3. Whether the Court below failed to appreciate that appellant is entitled for partition of the ancestral property ?
