                                Issue notice on admission and I.A. No.7614/2023 to the respondents on

payment of PF within 7 working days, failing which this revision shall stand dismissed without further reference to the Court.

In the meantime, both the parties are directed to maintain status-quo in respect of land Khasra No.805 (New no.1206) admeasuring 6.71 Hectares of village Banki, Tahsil and District Seoni and the respondents are also restrained from alienating the land Khasra No.805 (New no.1206) until further orders.

This Court while disposing of Civil Revision No.380/2017 passed order dated 21.03.2023 with the specific direction to consider the application under Section 152 read with Section 151 CPC afresh on its own merits without being influenced by the impugned order dated 28.06.2017 and has also mentioned the factual position in detail existing in the plaint and judgment and decree dated

23.01.2007, but from perusal of the impugned order dated 09.05.2023 it appears that again the learned Court below has not cared to pass the impugned order and it further appears that it has not considered the plaint averments so also the judgment and decree passed on 23.01.2007.

Therefore, Principal Registrar (Judicial) is requested to seek explanation from the learned Civil Judge, who has passed the impugned order dated 09.05.2023 in MJC No.90/2017, before next date of hearing.
