Also heard on I.A. No.23929/2022, an application for suspension of

sentence and grant of bail filed on behalf of appellant.

Appellant has been convicted for the offence punishable under Section 7 of P.C. Act and sentenced to R.I. for three years and fine of Rs.15,000/- and under Section 13 (1)(d)(i) r/w Section 13 (2) of P.C. Act and sentenced to R.I. for four years and fine of Rs.15,000/- with default stipulations.

It is pointed out by learned counsel for the appellant that the brother of appellant has expired today. Appellant is under custody since the date of judgment i.e. 09.12.2022. He has remained under custody for more than two months now and the appeal is going to take a long time to be heard finally.

In view of the aforesaid, I.A. No.23929/2022 is allowed. The remaining jail sentence of appellant is hereby suspended subject to depositing the fine amount and furnishing a personal bond in the sum of Rs.50,000/- (Rs. Fifty Thousand Only) with one surety in the like amount to the satisfaction of the trial Court concerned, with a further direction to appear before the Registry of this Court firstly on 03.10.2023, and also on such other dates as may be fixed by the Registry in this regard during pendency of this appeal.
