                                This petition coming on for admission this day, th e court passed the
                          following:
                                                               ORDER

At the outset learned counsel for the petitioner submits that this petition is squarely covered by decision of Coordinate Bench of this Court in the matter of Smt. Kushum Bai vs. State of M.P. passed in W.P. No. 618/2022 dated 13th of June, 2022, whereby on the similar set of facts the Coordinate Bench of this

Court had relegated the party to avail the statutory remedy available to them before the concerning Magistrate under Sections 200 and 156 (3) of Cr.P.C. He prays that similar directions may be issued and liberty may be granted.

Learned Government Advocate has no objection if such liberty is granted and the petitioner is directed to approach the concerned Magistrate for availing the statutory remedy available to him under the law.

Prayer so made by the counsel for the petitioner to dispose off the matter in the light of the judgment passed by this Court in the W.P. No.618/2022 on 13th of June, 2023 is acceded to and the petition is disposed of with liberty to the petitioner to avail the statutory remedy available to him under the law.
