Heard on I.A. No.15652/2022, which is repeat application filed on behalf of appellant Vinod Kumar Sharma for suspension of remaining jail sentence and grant of bail.

The appellant has been convicted under Section 8/18 of NDPS Act and sentenced to undergo 10 years R.I. with fine of Rs.1,00,000/- with default stipulation vide judgment dated 13.12.2018 passed by Additional Special Judge, Mandsaur (NDPS) in Special Case No.16/2015.

Learned counsel for the appellant submits that the appellant has completed 8 years of his jail sentence out of 10 years. He is ready to deposit the amount as awarded by the Trial Court. This is appeal of 2019 and there is no possibility of early hearing of this appeal in near future. The appeals pertaining

in the year 2009 are pending awaiting final hearing.

Learned counsel for the respondent opposes the prayer made by the appellant and prays for its rejection.

Heard both sides.

T h e execution of remaining jail sentence of appellant- is hereby suspended and it is ordered that the appellant be released on bail upon his furnishing a personal bond for a sum of Rs.2,00,000/- (Rupees Two lacs Only) with one solvent surety of the like amount to the satisfaction of the trial Court Signature Not Verified Signed by: PRAVEEN NAYAK Signing time: 03-02-2023 18:43:00
