At the outset, learned counsel for the respondent No.1 submits that he had deposited the security for the election petition by cyber mode but in the wrong head as the head was not of election petition but he relied on the
judgment of Division Bench of this Court in Renu Shah Vs. Kant Shirh Devsingh 2010(4) MPLJ 405.
Learned counsel for the petitioner could not specify the judgment on which he relied whether if the deposit is made in the wrong head of the Government then what would be consequence but he has filed a series of judgment otherwise to justify this petition. He further submits that as per the argument, which was heard on 19/12/2023, this petition may be decided on the basis of grounds raised in the petition.
Therefore, case is reserved for order.
