      Th is appeal coming on for hearing this day, t h e court passed the
following:
                                   ORDER

Appellant preferred this appeal under Section 374 of the Cr.P.C

aggrieved by the judgment dated 29.11.2011 passed by Additional Sessions Judge, Sironj by which he was convicted for the offence under Section 323 of IPC till rising of Court and fine of Rs.500/- by judgment dated 29.11.2011.

In brief facts of the case are that Ahalkar lodged a report against present appellant and five other accused persons that at 2 P.M., a quarrel took place taking into account of tractor in which appellant and other persons did marpeet with Ahalkar. He lodged a report. Offence was registered under Sections 147, 148, 323/149, 324/149, 294,506 of IPC. Appellant was arrested. Charge-sheet

has been submitted. Except appellant everybody was acquitted. He convicted for the aforesaid offence.

Perused the record.

On perusing the evidence of complainant Ahalkar Singh along with other witnesses and medical report, the learned trial Court rightly convicted the aforesaid offence under Section 323 of IPC till rising of Court and fine of Rs.500/-.

Considering the facts and circumstances of the case, no interference is warranted. The appeal is dismissed.
