The petitioner before this Court is aggrieved by the inaction on the part of the respondents to grant them regular pay scale from the date of his initial appointment.

Innocuous prayer is made by the petitioner to decide his petition in the light of judgment passed in W.A.No.346/2008 (Smt. Usha Ranawat Vs. State of M.P. and others) decided on 18.12.2006.

Counsel appearing for the State fairly submits that he has no objection and submitted that the representation of the petitioner be considered and decided but he has also contended that the petitioner may file fresh representation along with the copy of the order before the competent authority within a period of 10 days along with the copy of this order and competent authority is directed to consider and decide his representation in

accordance with law taking into consideration the order passed in W.A.No.346/2008 (Smt. Usha Ranawat Vs. State of M.P. and others) and the outcome be communicated to the petitioner within a period of two months.

It is made clear that this Court has not expressed any opinion on the merits of the case.

Accordingly, the petition stands disposed of. Certified copy as per rules.
