It is submitted by the counsel for the applicants that the trial is

pending since 2016 and six long years have passed, but it has not

come to a logical end and, therefore, the Trial Court may be directed

to conclude the trial within a period of three months.

The applicants have not filed the copies of the order-sheets of

the Trial Court to show that the applicants are not responsible for the

delay. However, it is equally true that the accused has a fundamental

right of speedy trial. Therefore, in the light of the judgment dated

11.3.2022

passed by the Supreme Court in SLP (Crl.) Diary

No.30839/2021 in the case of M. Gopalakrishnan & Ors. vs.

Pasumpon Muthuramalingan & Anr., as well as in the light of the

fact that the trial is pending for the last six years, therefore, without

effecting the calendar of the Trial Court, it is directed that the Trial

Court shall make every endeavour to conclude the trial as early as

possible by ensuring that no date of trial shall be given beyond the

THE HIGH COURT OF MADHYA PRADESH M.Cr.C. No.11703/2022 Balveer Singh Tomar and others Vs. State of M.P.

period of 10 days.

With aforesaid, the application is disposed of.
