Learned counsel appearing for the petitioner submits that the controversy is squarely covered by the judgment passed in Writ Appeal
No.357/2016 (Ramnarayan Sharma Vs. State of M.P. and others) decided on 06.03.2017, wherein it is held that in pursuance to Rule 66 sub rule (4) of the M.P. Civil Services (Pension) Rules, 1976 no such recovery can be ordered after retirement.
Learned counsel for the State submits that he is not in possession of the file, therefore, prays for short adjournment.
In such circumstances, the case is adjourned.
Learned counsel for the State is directed to examine the aforesaid aspect in the light of the judgment passed in Writ Appeal No.357/2016 by the
next date of hearing.
