Heard on I.A. No.28399/2021 for suspension of sentence and grant

of bail to the applicant.

This revision is directed against the appellate judgment dated

9.09.2021 passed by I Additional Sessions Judge, Shivpuri in Cr. Appeal

No.340/2019, whereby the judgment dated 3/9/2019 passed by JMFC,

Kolaras, District Shivpuri in RCT No. 763/2017 has been affirmed.

Consequently, the applicant stands convicted under section 354 of the IPC

and sentenced to undergo R.I. for 1 year with fine of Rs.500/- and under

section 341 of the IPC to undergo S.I. for 15 days with fine of Rs.200/-

with corresponding default stipulations and with the direction that the

custodial sentences shall run concurrently.

Learned counsel for the applicant submits that the applicant was on

bail during trial and appeal and has not misused the liberty so granted.

Disposal of revision is likely to take time and owing to COVID-19, THE HIGH COURT OF MADHYA PRADESH Cr. Revision No.2271/2021 (Rampal Gurjar Vs. The State of M.P.)

outbreak, detention of applicant in already congested prisons may be

detrimental.

The prayer is opposed by learned Public Prosecutor.

Taking into consideration the facts and circumstances of the case,

I.A. is allowed.

It is, therefore, directed that if applicant namely Rampal Gurjar

deposits the entire fine amount, if not already deposited, and furnishes a

personal bond in the sum of Rs. 50,000/-(Rupees fifty thousand) with a

solvent surety in the like amount to the satisfaction of trial Court for his

appearance before the Registry of this Court on 28th October, 2021 and

on such subsequent dates as may be fixed in this regard, the sentences of

imprisonment awarded to him shall remain suspended till further orders

and he shall be released on bail.
