Instant criminal revision has been filed under Section 397 r/W 401 of Cr.P.C. being aggrieved by the impugned judgment dated 25.08.2021 passed in Cr.R. No. 48/2021 by the Additional Sessions Judge, Tarana, Distt. Ujjain
arising out of the order dated 06.09.202 passed in Cr.Case No. 48/2011 by JMFC, Tarana Distt. Ujjain Upon hearing leanred counsel for the petitioner, in the considered opinion of this Court, challenge to the order of revision u/S 397 r/S 401 Cr.P.C. is barred as per provisions of section 397 Cr.P. C and therefore the instant criminal revision is not maintainable.
Faced with the situation, learned counsel for the petitioner seeks leave of the Court to withdraw the present petition with liberty to take recourse under appropriate provision of law before appropriate forum.
Prayer accepted.
Cr.R. stands dismissed as withdrawn, with liberty as aforesaid.
