Submissions were made on admission and IA No.6816/2021, which is an application for suspension of sentence of appellant Hemraj.

The appellant has been convicted under Section 368 of IPC and sentenced to 7 years R.I. with fine of Rs.500/- and default stipulation by the Special Judge, SC/ST (Prevention of Atrocities) Act 1989, West Nimar, Mandleshwar (M.P.) vide judgment dated 10.3.2021 passed in Special Case No.35/2017.

As per the prosecution story, the appellant had given shelter to prosecutrix and the main accused who was his nephew knowing that the prosecutrix had been kidnapped or abducted and had wrongfully confined the minor prosecutrix in his home for 4 days.

After making submissions, learned counsel for the appellant seeks to withdraw the suspension application.

Accordingly IA No.6816/2021 is dismissed as withdrawn.

The appeal is admitted for final hearing.

The appeal be listed for final hearing in due course.
