Petitioner is challenging the transfer order dated 31.08.2021, whereby

t h e petitioner has been subjected to transfer from the office of District Treasury, Mandla to District Pension Office, Dindori, District-Dindori.

I t is submitted that earlier petitioner was transferred on 03.07.2017 from District Office, Mandla to PAO, Tejaswini, Pariyojna, Mandla. Thereafter, he was transferred back to Mandla treasury on 15.03.2019. It is further submitted that the wife of the petitioner is suffering from cancer and is posted at Mandla and is 90 years aged father is also residing with petitioner. He also submits that he is the only member in the family who looks after his father and wife.

Learned counsel appearing for the respondents has objected to the prayer made by the petitioner on the ground that the transfer is a condition of service therefore, prays for dismissal of the petition.

Considering the judgment in the case of R.S. Chaudhary and Others v. State of M.P. and Others, ILR (2007) MP 1329 and in the case of Mridul Kumar Sharma Vs. State of M.P. and others reported in ILR (2015) MP 2556, it is submitted that the representation submitted by the petitioner will be considered and decided expeditiously.

In such circumstances, a fresh representation be filed by the petitioner to respondent no.2 within a period of 7 working days along with all the relevant documents and in case if such a representation is filed then
