Shri Rajesh Kumar Shukla, learned Dy. Advocate General for the

State.

Heard through video conferencing.

I.A. 14446/2021, an application of temporary suspension of

sentence filed on behalf of appellant is taken up and considered.

It is informed that mother of appellant has expired on 6/5/2021 and

13th day ceremony is scheduled to be held on 17/5/2021.

The factum of death of mother of appellant has been verified by

the State and found to be true.

In view of above, this Court deems it appropriate to allow I.A.

14446/2021, an application for temporary suspension.

It is directed that jail sentence of the appellant-Netrapal Lodhi shall

remain suspended temporarily and he be released on bail on furnishing

personal bond in the sum of Rs. 25,000/- (Rs. Twenty Five Thousand)

with one solvent surety of the like amount to the satisfaction available/

In-charge Magistrate concerned provided that the appellant shall

surrender himself to custody before said Magistrate on 20/5/2021 for

undergoing remaining part of jail sentence as per the impugned judgment.

Let the case be taken up on 7/6/2021 for the appellant to file proof

that he has surrendered before the court concerned in compliance of the

above direction.

Registry is also directed to requisition report regarding surrender

by appellant in terms of aforesaid directions from concerned court-below.
