        Shri Rajesh Pathak, learned counsel for the appellants.

        Shri Rohit Mishra, learned Additional Advocate General for the

respondent/State.

IA No.11821/2021, an application for urgent hearing, is taken up,

considered and allowed for the reasons mentioned therein.

Also heard on I.A. No.13140/2021, an application seeking interim

suspension of sentence and grant of bail moved on behalf of the sole

appellant - Raju Kalawat on the ground of immersion of ashes of his

wife.

Learned counsel for the appellant submits that wife of the appellant

has expired on 10/04/2021 and being the husband, presence of the

appellant for performing last rite/immersion of ashes is necessary.

State has not filed report as sought by this Court to verify the

factum of death of appellant's wife.

In these circumstances, this Court is inclined to grant interim

suspension of sentence to the appellant. Accordingly, I.A.

No.13140/2021 is allowed and it is directed that execution of jail

sentence of the appellant- Raju Kalawat shall remain suspended from

06/05/2021 to 15/05/2021 on furnishing a personal bond in the sum of

Rs.50,000/- (Rupees Fifty Thousand Only) with one solvent surety of

the like amount to the satisfaction of the concerned Magistrate available

on the condition that the appellant shall surrender before the concerned

CJM on 16th of May, 2021 for serving out the remaining part of jail

sentence awarded to him under the impugned judgment.

Copy of the order be sent to the concerned trial Court with a

direction to send a report to this Court regarding the appellant's

surrender.

List this case in the week commencing 17th of May, 2021.

Certified copy/e-copy as per rules/directions.
