Learned counsel appearing for the petitioner submits that the ordinance No.6/2014 provides for the moderation of the answer sheets which,

according to the petitioner, includes revaluation also in addition to the verification of the answer sheets. He has further referred to the answer sheets of Pathology I & II and Forensic Medicine of II year MBBS course of the petitioner and filed as additional documents and has submitted that there is no evaluation of the answer sheets done at all as there in no answer wise marking and no marks awarded have been mentioned in the answer sheets, therefore, in terms of the judgment of the Supreme Court in the matter of High Court of Tripura vs. Tirtha Sarathi Mukherjee (2019) 16 SCC 663 , revaluation is required to be done. He further submits that the last date of submission of the

examination form is 25.03.2021 and the examinations for the III year MBBS are going to commence on 10.04.2021, therefore petitioner should be provisionally permitted to appear in the examination.

Learned counsel for the respondent No.1 prays for short adjournment to point out as to how the evaluation of the answer sheets is done and how the marks are awarded. He also prays for time to advance his arguments if any provision for revaluation of the answer sheets exists or under the provision of moderation whether revaluation is permissible.

The counsel for the respondent No.1 is also directed to keep some competent person from the respondent-University present before this Court to apprise about the manner of evaluation of the answer sheets. Signature Not Verified SAN List on 24.03.2021.
