Heard on petition filed on 15.2.2021 under section 439 of CrPC on behalf of applicant Ajay Kol in connection with Crime No.54/2020, registered at Police Station Nowrojabad, District Umaria, under sections

294, 506-II, 435, 436 and 427 of IPC.

It is submitted by the counsel for applicant that more than one year has been passed and the trial of S.T.No.23/2020 is pending before the Sessions Judge, Umaria. The case has been listed for prosecution evidence on 23.3.2021. No any witness has been examined till today. Therefore, the applicant should be enlarged on bail. It is also submitted that the applicant is ready to deposit the amount of Rs.25,000/-.

The counsel for State opposed the application.

It appears from the record that the applicant caused the mischief by set a temple ablaze and by the act of fire, he caused the damage of about 25,000/- to the property belonged to the temple.

Looking to the custody period of applicant and in the absence of his previous criminal background, without commenting upon the merits of the case, the application is allowed with the condition that the applicant will deposit Rs.25,000/- with the trial court. Thereafter, he shall be released on bail upon his furnishing a bail bond worth Rs.50,000/- (Rupees Fifty Thousand) and a personal bond of the same amount to the satisfaction of the trial Court.

The amount, so deposited, will be invested by the trial court with Signature SAN Verified Not any nationalized Bank in FDR for a suitable term and the final order will Digitally signed by TRUPTI GUNJAL Date: 2021.03.22 18:01:10 IST 2 MCRC-9754-2021 be passed by the trial court at the time of judgment in this regard.

At the time of releasing the applicant from custody, all the instructions issued by the Government related to COVID-19 shall also be followed by the concerned authorities.

Accordingly, this M.Cr.C stands allowed.
