Heard on I.A.No.1458/2021 application for withdrawal of this Second Appeal which is not admitted yet. However, interim relief has been granted.

This appeal has been preferred against judgment and decree dated

30.9.2015 passed in Civil Appeal No. 31A/2014 by the 3rd Additional District Judge, Mandla against the judgment datd 31.1.2008 passed in Civil Suit No.85A/2005 by the I Civil Judge, Class II, Mandla.

As the appellant who is major is not interested to continue this appeal and prays for its withdrawal. Therefore, the appellant is permitted to withdraw this Second Appeal and as per law the appellant cannot file any appeal further with regard to the present subject matter.

In this case Respondent No.8 is participating in the proceedings. Therefore, it is directed that the cost of this litigation shall be borne by the

appellant with regard to Respondent No.8.

Accordingly, schedule of cost be prepared. Copy of this order be sent to both the courts below.
