It is an application for seeking permission to withdraw the appeal. The prayer made in the application reads thus:
"It is, therefore, prayed that this Hon'ble Court be pleased to permit the appellant to withdraw the present First Appeal by adjusting the subject matter of suit wholly in terms of the judgment and decree passed by the court below as well as the written compromise referred to above as well as to discontinue the interim order passed in the present appeal, in the interest of justice."
However, the learned counsel for the appellant submitted that sum and substance of the prayer made is that he simply wants to withdraw this appeal.
In view of the compromise arrived at between the parties and other facts and circumstances of the case, the application is allowed.
Permission to withdraw the present appeal is granted to the appellant. The appeal is dismissed as withdrawn.
