This application under Section 439 of Cr.P.C. has been filed for
grant of bail.
The applicant has been arrested on 22/12/2020 in connection
with Crime No.60/2020 registered at Police Station Bharoli, District
Bhind for offence under Sections 379 and 414 of IPC, Section 51 and
177 of M.P. Motoryan Adhiniyam Rules 1994 and Section 3 and 81
of Motoryan Adhiniyam 1988.
This repeat application has been filed on the ground of delay.
During the course of arguments, it is submitted by the counsel for the
applicant that the evidence of the witnesses have already been
recorded and even the final arguments have been advanced but due to
suspension of normal Court functioning, the judgment could not be
delivered.
Considered the submissions made by the counsel for the
applicant.
It is the case of the applicant that the final arguments have
already been heard and the case is reserved for judgment. Under
these circumstances, the Trial Court is directed to deliver the
judgment within a period fifteen days from the filing of certified copy
of this Order. However, it is made clear that if the final arguments
have not been heard, but the evidence is over, then the Trial Court
shall conclude the Trial within a period of one month from the date of
resumption of normal Court functioning.
With aforesaid observation, the application is hereby
dismissed.
The applicant is directed to submit a copy of this order before
the Trial Court for necessary information and compliance.
