      The applicant has been arrested on 06.03.2021 in connection

with Crime No.96/2021 registered at Police Station Inderganj Distt.

Guna for offence under Sections 363, 376 of IPC and under Section

3/ 4 of Protection of Children from Sexual Offences Act.

      In view of the fact that date of birth of prosecutrix is

14.12.2004

and she is still minor and filing of charge-sheet cannot be

said to be change in circumstance in the light of the judgment passed

by the Supreme Court in the case of Virupakshappa Gouda and

Another vs. The State Of Karnataka and Another reported in

(2017) 5 SCC 406, the Counsel for the applicant seeks permission of

this Court to withdraw this bail application.

It is accordingly dismissed as withdrawn.
