This third application under Section 439 of Cr.P.C. has been
filed for grant of bail. The second application was dismissed as
withdrawn by order dated 16/3/2021 passed in M.Cr.C.
No.14105/2021.
The applicant has been arrested on 9/1/2021 in connection
with Crime No.286/2020 registered at Police Station Umari,
Distt. Bhind for offence under Sections 326, 325, 324, 323, 294,
506 and 34 of IPC.
According to the prosecution case, a judgment and decree
was passed against the applicant and in spite of that, he took the
law in his hands and tried to forcibly take possession of the land,
which was decreed in favour of the complainant. The allegation
against the applicant is that he had assaulted on the head of the
complainant and corresponding injury has also been found.
In view of the serious nature of allegations against the
applicant and disrespect shown by him towards the decree of the 2 THE HIGH COURT OF MADHYA PRADESH M.Cr.C. No.23553/2021 Rajesh Baghel Vs. State of M.P.
Court, no case is made out for grant of bail. Accordingly, the
application fails and is hereby dismissed.
