Shri Anil Lala, learned counsel for the petitioner. Shri Pushpendra Verma, learned Panel Lawyer for the State. Counsel for the petitioner has challenged the order dated 22.3.2021

passed by Collector Chhatarpur. His appeal was not admitted for want of impleadment of necessary party. He submitted that petitioner has challenged the order by which his fair price shop has been withdrawn from the society. If that shop has been allotted to some other society then said Society is not interested party in the petition and Collector had committed an error in passing the impugned order. Counsel for the petitioner has relied on the judgment passed by the Apex Court reported in 2016 (2) SCC 779-Poonam Vs. State of U.P. and others.

Counsel for the State prays for short time to look into the aforesaid

preposition of law. It is submitted by him that file has not been allotted to him, therefore, he is unable to address this Court on the said issue.

List this matter on 16.7.2021 for consideration.
