This second application under Section 439 of Cr.P.C. has been
filed for grant of bail. The first bail application was dismissed by
order dated 03.06.2021 passed in M.Cr.C. No.25713/2021 with
liberty to revive the prayer after undergoing some reasonable period
of detention.
The applicant has been arrested on 02.04.2021 in connection
with Crime No.278/2021 registered at Police Station Morar Distt.
Gwalior for offence under Section 49-A of Excise Act.
The first bail application was dismissed by considering the
criminal history of applicant, according to which as many as 24
criminal cases have been registered against him.
It is submitted by counsel for the applicant that the applicant
has already been acquitted in 11 cases and he has filed the copy of
the same.
This court has gone through the judgments passed in 11 cases
and in all these cases either witnesses have turned hostile or have

entered into compromise.
Thus, considering the criminal antecedents of the applicant and
the fact that the witnesses are not coming forward to depose against
the applicant, this Court is of the considered opinion that no case for
grant of bail is made out.
Accordingly, application fails and is hereby dismissed.
