Petitioners have filed this present writ petition making a prayer that service rendered as Ad-hoc Assistant Professor from 1980 to 1987 was not

counted for granting pensionary benefits to the petitioners. Petitioners have given various representations to the authorities but same have not been considered and no decision has been taken on same.

Counsel appearing for petitioners has relied on judgment reported in Prem Singh Vs. State of U.P.; (2019) 10 SCC 516 and Punjab SEB Vs. Narata Singh; (2010) 4 SCC 317.

O n strength of said judgment, counsel appearing for petitioners submitted that services rendered as ad-hoc employee ought to have been counted for granting pensionary benefits to the petitioners.

Considering the fact that grievance of the petitioners had not been addressed to by the respondents and no final decision has been taken on the representations preferred by the petitioners, this writ petition is disposed of with direction to respondents to consider and decide the fresh representation which will be preferred by petitioners within a period of seven days from the date of receipt of certified copy of the order passed today. If such representation is preferred by petitioners before respondent No.1, then said representation shall be considered and decided by respondent No.1 keeping in view the law laid down by the Apex Court within period of 90 days from the date of receipt of fresh representation of petitioners and certified copy of the order passed today.

With the aforesaid direction, writ petition is disposed of.
