Shri Manu V.John, learned PL for the respondent/State.
With the consent of parties, the matter is heard finally. At the outset, learned counsel for the petitioner placed reliance on the order dated 4.11.2019 passed in W.P.No.21196/2019 (Deepak Bajaj Vs.
State of M.P.) and urged that this petition may be decided in terms of order passed in Deepak Bajaj (supra). Shri Rawat submits that this matter is identical to that of Deepak Bajaj (supra).
Learned Panel Lawyer did not dispute the aforesaid fact but urged that he is not aware whether the order passed in Deepak Bajaj and other similar cases were called in question in any writ appeal/SLP etc. Since, it is not in dispute that this matter is identical to Deepak Bajaj (supra), I deem it proper to apply the aforesaid judgment mutatis mutandis in the present case.
Accordingly, this petition is allowed in terms of order passed in Deepak Bajaj(supra).
