Heard on the question of admission.

Perused the impugned judgment and record of the court below. Appeal involves arguable points, hence, admitted.

Also heard on IA No. 9527/2021, which is an application for suspension of sentence and grant of bail to appellant.

Appellant has been convicted under Section 304-III and 323 (on three counts) and sentenced to undergo rigorous imprisonment for 10 years with fine of Rs. 500/- and rigorous imprisonment for one month each with fine of Rs. 100/- each with default stipulation.

Learned counsel for the appellant submits that appellant has been sentenced to undergo RI for 10 years out of which he has already served out five years sentence. As such he has already served out half of the jail sentence

awarded to him. He submits that the final hearing of the appeal would take a long time. Therefore, remaining jail sentence of appellant may be suspended.

Learned counsel for the respondent-State has opposed the bail application.

Considering the facts and circumstances of the case, without commenting anything on merit of the case, IA No. 9527/2021 is allowed.

It is directed that appellant be released on bail upon his furnishing a personal bond in the sum of Rs. 50,000/- with a surety bond of like amount to the satisfaction of trial Court concerned for his appearance before the Registry of this Court on 6.4.2022 and on such other dates as may be fixed by the Registry in this regard.
