This second application under Section 438 of CrPC has been

filed for grant of anticipatory bail. The first application for grant of

anticipatory bail was dismissed by order dated 11.11.2021 passed in

M.Cr.C. No.55184/2021.

The applicant apprehends his arrest in connection with Crime

No. 577/2021 registered at Police Station Bahodapur, District Gwalior

for offence punishable under Sections 498-A, 306/34 of IPC.

It is submitted by the Counsel for the applicant that the only

change in circumstance is that one other co-accused, namely Deepak

Sharma has been granted interim bail by the Supreme Court.

Heard learned Counsel for the applicant.

According to the prosecution case, the husband of the deceased

got appointment as Compounder after five years of the marriage and

thereafter the applicant and other co-accused persons started

demanding Rs. 5 Lacs and were also humiliating and harassing her on

account of non-fulfillment of their demand and also by calling her that

she is of a dark complexion. It is clear that when the husband of the

deceased was an unemployed person then there was no harassment or

demand of dowry but the movement he got appointment, the attitude

of applicant and other in-laws changed towards the deceased and they

started demanding Rs.5 Lacs. Further, in the light of the judgment

passed by the Supreme Court in the case of Taramani Parakh vs.

State of M.P. reported in (2015) 11 SCC 260, no case is made out for

grant of anticipatory bail.

The application fails and is hereby dismissed.
