Applicants had filed this petition under Section 482 of the Code of Criminal Procedure for quashing of the order dated 24.2.2021 passed in Criminal Appeal No. 320/2019 by which their application for compounding

offence was dismissed by Appellate Court. Appellate Court had considered the application filed by Sanju and his wife namely Smt. Deepti Tamrakar for compounding offence. Appellate Court held that since offence is not compoundable, therefore, compromise cannot be granted and application for compounding I.A.No.1 was dismissed. Being aggrieved by order of dismissal dated 24.2.2021, applicants had filed this petition for quashing of the said order.

No fault could be found in order dated 24.2.2021. Application was rightly dismissed as offence was not compoundable. Statements of

applicants were recorded by Registrar (J-II) on 23.9.2021. It has been stated that complainant Smt. Deepti Tamrakar and Sanju had entered into compromise voluntarily and there was no force and coercion. Applicant nos.1 and no.4 are living together. They had amicably settled their dispute and want to live married life together.

Considering the report of Registrar (J-II), exercising inherent powers under Section 482 of the Code of Criminal Procedure to secure ends of justice, it is ordered that judgment dated 30.11.2019 passed in Criminal Case No. 2450/2015 is quashed. Appeal filed by appellants becomes nugatory and, therefore, disposed off as infructuous and bail bonds filed by applicant nos. 1, 2 and 3 are discharged and applicant nos. 1, 2 and 3 are acquitted from the criminal case.
