The question involved in this case is that whether order framing charge is an interlocutory order or not.

Learned counsel for the petitioner referred to Judgment of Sanjay

Kumar Rai vs. State of Uttar Pradesh and another: AIR 2021 SC 2351; wherein it has been held that order framing charges or refusing discharge are neither interlocutory nor final in nature.

Learned counsel for the petitioner further referred to an order of coordinate Bench of this Court dated 03.03.2021 passed in CRR No. 349/2021, wherein it is held that- "The framing of charges is an interlocutory order."

Learned counsel for the appellant as well as the learned Panel Lawyer seeks two weeks time to argue on this issue.
