Heard on the question of admission as well as on interim relief

Issue notice on the question of admission as well as on interim relief to the respondents on payment of process fee by RAD mode within seven working days, failing which, this petition shall stand dismissed automatically without further reference to this Court.

Learned counsel for the petitioner submits that the petitioner is working on daily wages basis on the post of Hand Pump Technician, which is a class III post and in the light of judgment delivered by the Full Bench of this Court in the case of Ashok Tiwari vs. M.P. Text book Corporation and Anr. reported in 2010 (2) MPHT 469 (FB), the daily wager employee cannot be transferred.

In the meanwhile, till next date of hearing, effect and operation of impugned order dated 17/08/2021 (Annexure P/1) so far as it relates to the petitioner shall remain stayed.

List this matter in the week commencing 27th September, 2021
