Shri Vaibhav Jain, learned counsel for the respondent on
advance copy prays for two weeks' time to file reply in the matter.
I.A. No.6999/2021, an application for grant of interim relief is taken up.
Learned counsel for the applicant submits that main appellant Ramashankar Agnihotri was father of present applicants who died during the pendency of Criminal Appeal No.116/2008. This Court on 26.07.2016 opined that appeal stands abated and the present applicants were not aware about this order. In the main judgment apart from the sentence, fine was also imposed on the main applicant. Now the Court below is proceeding against the L.Rs. / applicants in order to recover the said fine. The applicants were never put to notice.
Considering the aforesaid and subject to hearing Shri Vaibhav Jain, till the next date of hearing, no coercive action be taken against the present applicants.
List the matter in the week commencing 23rd August, 2021.
