Learned counsel for respondent nos.2 and 3 has pointed out that against the impugned order dated 29/6/2020 the appeal Annexure P-8 is pending before the respondent no.2 and the respondent no.2 is ready to decide the appeal within a time bound period.

Learned counsel for the petitioner has submitted that the appeal be decided after duly considering the judgment of the Indore Bench in the case of Mahesh Giri vs. State of M.P. passed in W.P. No.17864/2019, whereas learned counsel for the respondent no.2 & 3 has placed reliance upon the judgment of this Court in the matter of Manoj Kumar Purohit and others

vs. State of M.P. and others 2016 Vol.1 MPLJ 449.

Considering the aforesaid, the present writ petition is disposed of at this stage without expressing any opinion on the merit of the matter by directing respondent no.2 to take an appropriate decision on the petitioner's pending appeal as expeditiously as possible preferably within a period of four weeks from the date of receipt of certified copy of this order after duly considering the judgments noted above and also any other applicable rule, regulation or circular.

With the aforesaid direction, the writ petition is disposed of.
