Shri Vivek Jain, Counsel for the petitioner.
It is submitted by Shri Jain that in view of Section 146 of CPC,
the petitioner can challenge the order passed by the Board of
Revenue. To buttress his contention, counsel for the petitioner has
also relied upon the judgments passed by the Supreme Court in the
case of Sm. Saila Bala Dassi Vs. Sm. Nirmala Sundari Dassi and
another reported in AIR 1958 SC 394 and Raj Kumar Vs. Sardari
Lal and others reported in (2004) 2 SCC 601. In order to explain the
delay in filing this writ petition, it is submitted by Shri Jain that
earlier the private respondents had maintained silence and now they
have filed a W.P. No.16973/2020 and notices were issued which were
received by the petitioner in the month of May, 2021 and only
thereafter it came to know about the impugned order dated
17.08.2016.
Keeping the question of delay and laches open, issue notice to
the respondents on payment of process fee by registered as well as
ordinary mode. Process fee be paid within three working days.
List this case along with W.P. No.16973/2020 for analogous
hearing.
